"He told me he was going to Daniel Morcombe my son"

AN ALLEGED vile threat and a hammer attack pushed Neil Daniel Xxavier's patience over the threshold, a court heard.

Xxavier appeared in Rockhampton Magistrates Court yesterday morning charged with one count each of being a public nuisance and possessing a dangerous drug, namely cannabis.

The court heard that about 5.45pm on February 6 police attended a Kawana address in relation to a disturbance and found Xxavier pacing on the roadway, looking agitated and yelling profanities and threats in the direction of a residence.

Police later found 1g of cannabis in a satchel carried by Xxavier.

As the police prosecutor read the details of the event, a smile spread across Xxavier's face and he began to snigger.

Magistrate Michael O'Driscoll warned him he wasn't impressed by his behaviour and he would have his chance to speak soon.

When Xxavier was granted his chance to speak, he told Mr O'Driscoll he found it laughable that he was in court, considering the alleged circumstances of the incident.

"The guy I was yelling at hit me with a hammer earlier that day," Xxavier alleged.

"And earlier that day I walked past his house and he told me he was going to 'Daniel Morcombe' my son.

"I'm actually a witness in the guy's court case."

Nevertheless, Xxavier pleaded guilty to both charges and Mr O'Driscoll handed down a $500 fine.
