Motorcyclist sues after Byfield crash

A CAPRICORN Coast man, 40, is suing for $300,000 damages after being knocked off his motorbike in an accident two years ago.

The man, from Bangalee, claims he has been left with permanent injuries to his right arm, right ankle and a toe after a ute hit his bike as he drove along Stoney Creek Road.

Last week he lodged a claim in the Supreme Court at Rockhampton against the driver of the Mazda ute that hit him and the driver's insurance company.

“The plaintiff was the rider of a Kawasaki motorcycle,” the claim says. “He was riding the motorcycle in a westerly direction and the ute was being driven in an easterly direction.

“They collided after the motorcycle had mounted the crest.”

The claims says the crash was caused by the negligence of the defendant, who it alleges was driving at an excessive speed and failed to keep as far left as possible.

The motorcyclist suffered a broken right elbow, a burst injury to his right great toe and bruising and cuts to other parts of his body.

Since the incident he has had depression.
