Bail refused for Mackay man who threatened to 'gut' wife

A FORMER police officer and Mackay man who threatened to "gut" his wife "like a pig" has failed in his bid to get out of jail before an appeal has been heard.

Jamie Valentine Victor Chetcuti was jailed for six months earlier this month for two counts of common assault.

He has launched an appeal against that conviction and sentence. But on Thursday he applied for bail pending the appeal.

In August, Chetcuti was convicted of holding a kitchen knife to his then-wife's body and threatened to "gut her like a pig" in front of their children.

Defence lawyer Scott McLennan told the court there was evidence some testimony during the trial may have been coached.

He said one of Chetcuti's children had changed his behaviour towards his client out of the blue after he "just remembered" alleged offending. 

"There's an inference of coaching and a strong one in my submission," he said. 

Mr McLennan said the trial judge had "very much undermined" his suggestion to the jury that the child might have been coached to testify in a certain way.

But Justice Martin Burns said as that evidence had been presented to the jury he did not believe it was enough to grant bail before the appeal was heard.

Justice Burns said in order to be granted bail pending an appeal Chetcuti would have to prove there was "exceptional circumstances".

Justice Burns said Chetcuti's case did not reach that qualification and instead urged Mr McLennan to expedite his client's appeal. Bail was refused.
