Boozed up mum swears at cops after drunken crash

"F--- it, hit me c---, the judge is going to love me."

It is not a statement you would expect from a 34-year-old mother of three, but was exactly what landed Samantha Lee Macey in a Gladstone Magistrates Court on Tuesday morning.

Macey was charged and pleaded guilty to one count of failing to provide a specimen of breath for analysis or blood for test on requirement.

The court hear that at 2.15am on November 22 Gladstone police attended a single-vehicle crash on Chapman drive in Clinton.

Eye-witness reports suggested Macey, who was driving with her four-year-old child and husband in the car at the time, had hit a gutter and taken her car wheel off its axis.

Police prosecutor Senior Constable Carl Spargo said the responding officers immediately recognised Macey was highly intoxicated.

There were also reports her husband had created a traffic disturbance after the incident happened, by running across the road several times and opening his door close to traffic.

After Macey's first breath test returned a blood-alcohol reading of 0.183, she was detained and transported back to the Gladstone Police Station for further testing.

She failed to supply a specimen of breath the first and second time of police requested and she was argumentative when given her final chance.

"The defendant told police, 'F--- it, hit me c---, the judge is going to love me'," Snr Cst Spargo said.

Macey appeared to snigger as Spargo recalled what she had said to police that night, which frustrated Acting Magistrate Ross Woodford.

"Once the police were there you became very arrogant and carried on as such," Acting Magistrate Woodford said.

"You were full of booze, you wouldn't know what day of the week it was."

Acting Magistrate Woodford fined Macey $900 and suspended her licence for 10 months.
