Brothers cleared of assault
A MOTHER broke down in tears as her sons, Yeppoon brothers Daniel James and Ricky Lawrence Vaughan, were cleared of seriously injuring three men.
The brothers were accused of doing grievous bodily harm to Nathan Reynolds during a party at a Magpie Ave, Yeppoon, home in February 2009.
Ricky was also charged with assault occasioning bodily harm on Ben Groves, and common assault on Ben's father, Leo Groves.
After more than two weeks on trial, a jury in the Rockhampton District Court last week found both Ricky and Daniel not guilty of all charges. Leaving the courthouse Daniel said he was pleased with the result.
"Mother will be very pleased," he said.
During the lengthy trial, the court heard evidence from a range of witnesses who were at the party and gave varying accounts of a fight that broke out on the front lawn after a group of people arrived attempting to gatecrash the party.
The violence left Nathan with a broken jaw, Ben with cuts and bruising to his face and Leo with closed head injuries, including fractures and no sense of smell.
Defence representatives Doug Winning and Ross LoMonaco painted a picture of a fight that had involved many people and had not been premeditated by either brother, while Crown Prosecutor Claire Kelsey suggested Daniel had called his brother to help him in the attack after a disagreement with Ben.
