Bankrupt car dealers ordered to pay $70k

A COUPLE whose Nambour used car dealership went bankrupt have been ordered to pay a former client $72,000.

Robert Lawrence Kelly and Gay Suzanne Kelly agreed to sell Russell Smart's Nissan Navara ute and Kingdom Kensington caravan at their business, Sunshine Coast Cars and Caravans, in January 2011.

Mr Kelly told Mr Smart the caravan had been sold and he had a buyer for the ute in October, 2011.

But Mr Smart took the matter to the Queensland Civil and Administrative Tribunal, which found in his favour, when he never received the money paid for either vehicle.

The court judgment published this week states the ute was sold for $25,000 and the caravan was sold for $47,000.

Mr Kelly told Mr Smart in 2012 the banks had frozen the business's accounts.

Business went from bad to worse for the couple in 2013, with Mr Kelly telling Mr Smart the bank had closed their business and seized their properties.
