Child rapist too drunk to recall sexual assault or rape

A MAN who sexually assaulted a stranger at a shopping centre on his birthday and three months later, physically hurt a 14-year-old when he digitally raped them, is eligible for parole.

The 34-year-old Rockhampton man was sentenced on Friday to a three-year prison term with parole eligibility on February 8, after having served 471 days in pre-sentence custody.

The sentence came after he pleaded guilty to one count of sexual assault and one count of rape.

Judge Alexander Horneman-Wren said the rape of a child is particularly abhorrent.

"The young girl you raped suffered an injury to her genitalia," he said.

The court heard the girl was asleep on a couch when he pulled her pants down. She woke to find him digitally raping her and eventually, she "managed to have enough strength of character to push him off".

"It caused her pain," Judge Horneman-Wren said.

The girl was the daughter of the man's cousin.

The sexual assault took place in a Brisbane shopping centre in July 2017 as the victim was walking along a corridor towards toilets.

He ran his hand up her leg, under her skirt and touched her buttocks.

Defence barrister Ross Lo Monaco said his client has "serious issues with alcohol" and was heavily intoxicated during both incidents.

He said the man had been drinking wine all day on the date of the sexual assault.

Mr Lo Monaco said his client did not remember either offence.

"Your history is littered with offences conducted when you are drunk," Judge Horneman-Wren said.
