Inquest hears truck death may have been avoidable

THE truck that backed into and killed Simon James Poxon did not need be reversed, a workplace health and safety investigator has told a court.

Mr Poxon was killed on February 26, 2013, at the Sherrin Rentals yard in Torrington, Toowoomba, when a truck reversed into the cherry picker he was refuelling - crushing him.

At a coronial inquest in Brisbane into Mr Poxon's death, workplace health and safety investigator Alison Cummings said she did not believe the truck needed to reverse at all.

When the inquest was being held in Toowoomba, the man who backed the truck into Mr Poxon, Jameson Boon, said a dump truck was in his way and he needed to reverse to get around it.

But Ms Cummings said Mr Boon should have had no problems driving the truck forward.

"At the end of the day, Mr Boon got in the truck and reversed it," she said.

"There was no need for him to reverse it. He could have easily driven it out."

Ms Cummings said Mr Boon could have avoided the dump truck because of the size of the yard.

"It's a big, big yard. He had sufficient room regardless of where the dump truck was," she told the court.

Ms Cummings was the lead WHS investigator into the crash before she left for a six-month stint in the Northern Territory, where she had previously worked as a police officer.

A different WHS officer took over from Ms Cummings and prepared the report presented to the coroner.
