Cousins duel using fire extinguishers on Brampton Island

A "FOOLISH" decision between cousins to have a fight using fire extinguishers has landed two men in court for their first appearance.

Neither saw any harm in having a duel using fire extinguishers and, as a result, spraying Brampton Island resort with a powdery white substance.

However, they aren't laughing now. Both looked sombre and embarrassed as they stood before Magistrate Ross Risson yesterday.

Reece Mark Pickering, 21, issued the challenge when he found a fire extinguisher and fired it at Elliot Ross Tate's legs.

The 18 year-old fired back.

In the process the resort, pathways and gardens were sprayed and four extinguishers were used, the Mackay Magistrates Court heard.

The pair had been exploring Brampton Island. They were passengers on a private vessel, which had stopped at the island on October 7 this year.

Despite seeing signs displayed labelling the resort as "private property" the pair continued their exploration thinking the resort was "abandoned", prosecutor Michael Ball said.

Duty solicitor Leisa Barnes, of Legal Aid Queensland, said it was a "young and foolish thing to do" and reiterated they thought the resort was abandoned.

The pair both pleaded guilty to trespass and wilful damage charges.

They had no criminal history, the court heard.

Ms Barnes said the pair had offered to clean up the resort but weren't able to because of the insurance.
Pickering, who is in Australia on a working holiday, was "very embarrassed by his action", Ms Barnes said.

Mr Risson said they were "foolish" in their actions.

"It might have seemed like a fun thing to do at the time (but) they've suffered a loss... and you've ended up in court," Mr Risson said.

He fined each $350 and ordered they both pay $403 compensation.

No convictions were recorded.
