Fined $1000 for desperate dash to shops

ISOLATED out of town and with no food, a Thangool man with a disqualified licence was nabbed by police driving into Biloela for supplies.

On January 15 the Biloela Magistrates Court heard that, on January 2, 45-year-old Garry Allan Black, who was working at a Thangool farm over the new year period, ran out of food and almost got away with a desperate dash to Biloela.

Sergeant Shaun Janes told the court that police pulled Black over on the Burnett Highway heading towards Thangool.

They did a random breath test and police discovered Black had a disqualified licence, handed down by the Toowoomba Magistrates Court in November 2018.

Mr Black’s defence lawyer Bianca Hight, from Ramos & Co Lawyers, told the court that Black’s situation could have become critical if he couldn’t purchase food and supplies.

“Over the Christmas period there were people off work from the removal company he works at and, as a result, he didn’t have access to food or supplies,” Ms Hight said.

“It would’ve been quite a serious situation if he wasn’t able to get any supplies.”

For the charge of driving without holding a drivers licence, Magistrate Philippa Beckinsale convicted and fined Mr Black $1000.

He pleaded guilty.

“When you say it’s serious, he wasn’t going to die, he had water out there,” Ms Beckinsale said.

“I just take issue with it being an emergency.

“You made the call to risk it when a taxi would have been cheap enough.”
