A TOOWOOMBA man had resorted to naked aggression during an argument with his partner, the city's Magistrates Court has been told.

Malcolm John Riley, 36, and his girlfriend had agreed to meet at her James St residence about 10am, April 22, to discuss the possible resurrection of their relationship.

The couple got into a verbal argument and she had tried to leave but Riley had stopped her, prompting a wrestle and both had fallen to the ground.

She got up and walked across James St to a shop, but when she turned around she saw a completely naked Riley behind her, police prosecutor Sergeant Al Windsor said.

Seeing a naked man outside their shop, staff called 000.

Then, about 9.55pm, May 2, police responding to an incident at a West St unit had approached Riley outside.

Giving his name as David Barry Kurtz, the suspicious sergeant checked the police computer which identified Riley, prompting him to run off but he was found five days later, Sgt Windsor said.

Riley had spent 108 days in custody before appearing by prison video link to plead guilty to wilful exposure, obstructing police, trespassing and breaching a court order.

His solicitor Brad Skuse said his client intended moving to Brisbane where he had work and to distance himself from Toowoomba and the woman.

Magistrate Robbie Davies declared the 108 days as time served and sentenced Riley to six months in jail but ordered he be released on parole immediately.
