Man who kissed girl half his age under supervision

A MAN who kissed and touched the breasts of a 13-year-old girl will return to Kingaroy under parole board supervision after being released from jail.

Jack Vernon Lever, 30, pleaded guilty at the Brisbane District Court to two counts of indecent treatment of a child under 16.

The court heard Lever met the girl online and befriended her on Facebook. The two then met at a party hosted by a mutual friend.

Between January 2014 and October 2015 Lever met with the girl less than 10 times. The girl was aged between 11 and 13 during this time.

On one occasion Lever kissed the girl and on another he kissed her and touched her breasts.

Lever was caught when the girl's mother answered her phone. Before she spoke Lever said "Hey babe, what's up?”.

When the mother spoke he hung up. An investigation found it was Lever who rang.

Lever has been in jail since January 26 when his parole was revoked after he failed a drug test.

Lever's barrister Catherine Cuthbert said his offending was at the lower end of seriousness for the charge.

"I think the time he has done ... is sufficient for the offending,” she told the court.

"Clearly it isn't appropriate for a 29-year-old man to be in a relations with a 12 to 13-year-old girl.”

Judge Anthony Rafter said a report on Lever's behaviour inside jail was "not encouraging”.

But Judge Rafter agreed Lever had spent enough time in jail for the crime.

He Rafter sentenced Lever to 12 months jail, suspended immediately and 18 months on probation.

Lever said he would return to Kingaroy. He will be under parole board supervision and have to undergo counselling.
