Man who shared 'ice' with pregnant woman avoids jail

A 33-YEAR-OLD man who shared a hit of "ice" with a 35-week pregnant woman has avoided actual jail time.

However, James Desmond Macey will have six months jail hanging over his head for the next two years after Judge Dennis Lynch QC ordered the term be wholly suspended.

Prosecutor Jennifer Cameron told Toowoomba District Court police had been called to a report of two people suspected to have overdosed at a Toowoomba residence on February 22.

The pregnant woman had called police saying both had injected the drug which apparently was a "bad batch" and both had become ill.

The pair directed police to stash of substance which weighed 0.229g andh contained ice.

Macey pleaded guilty to supplying and possessing a dangerous drug and possessing a drug utensil.

His barrister Frank Martin told the court his client had no previous convictions at all until about 12 months ago when he had become drug addicted.

A friend of his client's had left the drug at his home and though it appeared tainted with different coloured crystals he and the woman had decided to use it anyway, he said.

His client had since returned to live with his parents and had sought help for his addiction, Mr Martin submitted.

Judge Lynch noted Macey had led a useful and unblemished life until becoming addicted to ice and sentenced him six months in jail but ordered the whole term be suspended for two years.
