Murder trial in its final stages

MICHAEL Gelens was described as being a nice and sociable man who enjoyed a wine.

On December 18, 2012, the 43-year-old cycled home from his job at a sugar mill, arriving about 5pm.

When Andrew Drabsch, who lived at the same Holland St townhouse as Mr Gelens, went up for a shower he said "Mick" was alive and uninjured and there was no blood in the lounge room.

Police would later arrive, however, to find a blood-soaked couch, blood splattered around the room and Mr Gelens' body on the floor near a large pool of blood. His eye socket was fractured, facial bones shattered, jaw fractured on both sides, he had multiple cuts and gashes and three stab wounds to the left side of his neck. One of these stab wounds was fatal, cutting across the carotid artery and jugular vein.

Blaze Seaton Pearce has pleaded not guilty to murdering Mr Gelens at the West Mackay address. He said it was "self-defence".

The 38-year-old held fears Mr Gelens had drugged and raped him about a month before.

During his closing argument, defence barrister Dennis Lynch said that when Pearce confronted Mr Gelens about what happened he became defensive and aggressive and came at Pearce with a weapon that "must have been" a knife. Pearce had said he didn't remember much after that.

Crown prosecutor Michael Cowen said there was no evidence of Mr Gelens' sexual orientation and the only evidence about the alleged sexual assault came from the defendant. "Forgetfulness is the first refuse of a guilty mind," Mr Cowen said.

Mr Drabsch gave evidence that Pearce threatened him when he tried to phone for help.

Mr Cowen said that wasn't "a reference to self-defence... that is an act of aggression".

Evidence there was no bruising on Mr Gelens' body suggested he wasn't in a state to defend himself when most of the injuries were inflicted, Mr Cowen said.

Justice David North will deliver his directions to the jury on Monday.

It is expected they will then retire to deliberate.
