Naked 'activities' in full view of street earns man a fine

A MT LOFTY man caught standing naked in his front room window masturbating in full view of the street had been warned before by police about his exhibitionist behaviour.

Police had received a number of complainants about a naked Dale Terence Stewart standing in the front window of a Stuart St residence about 6.30pm, March 10, Toowoomba Magistrates Court heard.

One witness told police he and his family had been walking past the house when they saw Stewart, 47, who was standing in a window with the light on in full view.

Prosecutor Greg McIntyre told the court police had spoken to Stewart before about such behaviour.

Stewart pleaded guilty to a charge of wilful exposure.

His solicitor Joe Millican told the court his client had moved to Toowoomba from New South Wales in 2011.

When in New South Wales his client had been treated for mental health issues but since leaving that state he had been off his medication.

He had been under stress at the time and after this incident spent six days in hospital.

Stewart was now back on medication and wouldn't re-offend, Mr Millican submitted.

Noting the maximum penalty for the offence was $220, Magistrate Damian Carroll fined Stewart $150 but ordered the conviction not be recorded.
