Nurse not guilty of sex assault
3.50pm: A JURY has found Rockhampton nurse Allan Alfred White not guilty of sexual assault.
The jury returned with the decision this afternoon after Judge John Newton had earlier redirected them to find White, 40, not guilty on two other charges, one each of sexual assault and indecently touching a child.
White had pleaded not guilty on Monday to all charges which related to alleged incidents at Rockhampton Hospital between October 2007 and January 2008.
The prosecution had argued White, who was acting as an anaesthetic nurse, touched the genitals of three male patients who were unconscious on the operating table.
However, his defence lawyer John Allen contended White had been doing his role and the jury had to be confident beyond reasonable doubt the touching was an act towards sexual gratification.
