Sentence shrunk for man who attacked three men at ex's home

A MAN who crept into his ex-girlfriend's house and attacked three men with a nulla nulla has had his five-year sentence reduced on appeal.

Steven Broome was convicted in the Rockhampton District Court last year of one count of burglary in the night, two of assault occasioning bodily harm while armed, and one of common assault.

On November 11, 2011, Broome entered former girlfriend Melanie Kielly's house where a group of men was drinking in the area under her highset property in Rockhampton.

Broome's girlfriend and her children were inside the house.

One of the men, Isaac Kielly, noticed a shadowy figure outside the undercover area about 9pm.

Broome then stepped inside, looking angry and holding a stick, between 80cm-90cm in length, later described by witnesses as a nulla nulla.

He struck one of the other men, Shaun Muller, in the head, before hitting him on the arm about three times when he put his arms up for protection.

Mr Kielly yelled at Broome, who swung the nulla nulla at him, eventually hitting his hand, causing swelling and tenderness over the third knuckle.

Another of the men, John Murray, threw something at Broome before running from the house.

Broome followed Mr Murray but lost him and did not return to the house.

Although police attended that night, no complaint was made.

Following the assault, Mr Muller needed six staples for a cut on the top of his head and was left with bruises and abrasions on his forearm.

Complaints were made to the police and Broome faced trial in October, 2014.

Motive for the attack remains unknown and Broome did not give evidence at the trial.

Broome appealed his five-year sentence on the grounds his lengthy criminal history "overwhelmed the sentence process", resulting in a disproportionately high penalty when compared to the seriousness of the offence.

The original sentencing judge flagged Broome's history at the time, saying he was inclined to impose a higher sentence than comparable cases.

At the time, the judge described Broome's behaviour as "cold blooded, cowardly and malevolent".

He said the offences involved some level of premeditation.

Judges in the Supreme Court of Queensland Court of Appeal took one year off Steven Broome's sentence on June 26, finding such a sentence would be heavy, but not disproportionate to the seriousness of the offence.
