Man who set fire to father's house loses appeal

A TOOWOOMBA man who tried to burn down his father's house after he was refused a $1000 loan has lost his appeal.

Scott James Porter was sentenced to three years jail in March last year for causing $126,000 damage after dousing the main room of the house in petrol and setting it alight on September 6, 2011.

He sustained some burn injuries in the fire. Fortunately, neither his father nor sister were injured.

Porter was given an extra year on top of that sentence for stealing a car, dangerous driving while speeding and stealing fuel in October that year.

He sped away from police and then abandoned the car at a spot renowned for dumping stolen cars.

The wheels were removed and there was damage amounting to $17,000.

Porter was disqualified from driving for two years.

From age 10 he began drinking alcohol and from age 13 he would break into houses, steal, set fires and joy ride in cars.

Porter - a 24-year-old father of four, argued in the Queensland Court of Appeal that the arson sentence did not mitigate for his mental disorders.

But Justice Robert Gotterson, in a judgment handed down on Friday, said the sentencing judge clearly did so and found the sentence was not manifestly excessive.

He said the fire damage was extensive and put others at risk.
