Gympie man narrowly avoids jail for sex offence

A GYMPIE man narrowly escaped jail time when he pleaded guilty to sexual assault in Gympie District Court last week.

Bradley Terrence Lang, 38, who has an acquired brain injury, was charged with the offence.

The court heard Lang grabbed a woman by the arm and touched her inappropriately at her Gympie home.

His lawyer said his client had a reduced cognitive capacity and suffered from black-outs due to being deprived of oxygen at birth.

Judge B. Butler acknowledged the man's reduced intellectual capacity, but said it did not exclude him from following the law.

"You need to think before you act; you need to understand the serious consequences if you don't," Mr Butler said.

Lang, who has no previous history of sexual offending, was given a six month suspended jail term. "You've been on the cusp of going to prison today," the judge said, adding the prison sentence would hang over the defendant's head for two years.
