Withdrawal of bikie charge leads to bail after year in jail

POLICE thought Warwick man Lloyd Foran was a bikie associate and he has been in jail for more than a year waiting for his court case to be finalised.

But police have withdrawn allegations that he was associated with a vicious lawless association and Mr Foran, 19, has now been released on bail as a result.

Mr Foran, who is waiting for his case to be finalised in Bundaberg District Court, was granted bail on Wednesday after a Brisbane Supreme Court justice found he had already spent a long time in jail.

The court heard Mr Foran is facing four charges including deprivation of liberty, assault, threatening to kill and contravening a probation order.

The offences stem from an incident at a Bundaberg intersection last year when Mr Foran and his brother Geoffrey allegedly threatened a person in a car and were involved in a fight.

The court heard Geoffrey Foran was allegedly armed at the time. He is also still waiting for his case to be finalised.

At first Mr (Lloyd) Foran was charged under Queensland's strict anti-bikie VLAD laws but Justice Philip McMurdo said this element had now been withdrawn.

Justice McMurdo said Mr Foran had applied for bail twice but was rejected both times.

"On previous occasions he was facing more charges and they were in general more serious charges," he said.

He said Mr Foran previously faced 15 years jail if he was convicted of the VLAD offences but now it was much less.

It is unclear whether his case will go to trial or whether he will plead guilty, the court heard.

Justice McMurdo said Mr Foran had now been in jail for one year and two months and his time in remand could be longer than a possible sentence he would receive if convicted.

This was a "powerful consideration", he said.

Mr Foran was released on bail on strict conditions including that he report to police twice a week.

His case will be mentioned at Bundaberg District Court next month.
