'Woman took nude pics of 12yo sister'

A PALMWOODS resident who took topless photos of her 12-year-old sister for the benefit of her boyfriend faced Maroochydore District Court yesterday.

The woman, who cannot be named for legal reasons, pleaded guilty to two charges of indecent treatment of a child under 16, and two charges of distribution of child exploitation material.

She brought the law down on herself by approaching Caloundra Department of Child Safety in August last year concerned about the safety of her newborn in the company of her boyfriend, the baby’s father, as a result of recent criminal charges regarding the defendant’s four-year-old niece.

During the assessment, the defendant stated she had taken photographs of her sister topless for the benefit of her boyfriend between March 1 and March 30, 2009.

An interview was conducted with the sister, and police later executed a search warrant on the defendant’s home. The defendant was arrested and taken to Maroochydore Police Station, where she made admissions about taking the photos at the request of her boyfriend to keep him happy in the relationship.

She stated that she knew what she was doing was wrong, but did not want to disappoint her partner.

She said the photos had been deleted from the camera.

Judge John Robertson called it “bizarre and unpleasant behaviour”, and aired his disappointment that the defendant was still with her boyfriend given the circumstances.

On the charges of indecent treatment of a child, the woman was given nine months for each count, wholly suspended for two years from yesterday.

On the charges of distribution of child exploitation material, she was issued with 18 months’ probation from yesterday.

The defendant’s child is now living with her grandparents.

She has supervised visits once a week.
